SendNeo Terms of Service
These draft terms govern your use of SendNeo, an email service operated by Yorker Media. The legal desk will review this draft before publication.
1. The service
SendNeo provides a transactional email API and newsletter tools. Delivery is provided through Amazon SES. You may use one account for both jobs, subject to these terms, the Acceptable Use Policy, and the Privacy Policy.
2. Accounts and access
You must provide accurate account information and keep your credentials confidential. You are responsible for activity under your account and for ensuring that people with access follow these terms. Contact legal@yorkermedia.com if you believe a key or account has been compromised.
New accounts start in review. Until review is complete, live keys may send only to your own verified team email addresses. Test keys work fully. The review is a reputation and abuse-control measure and usually completes within one business day; it is not a promise that every account will be approved.
3. Messages and recipients
You are responsible for the content you send, the addresses you use, and the legal basis for contacting recipients. Marketing mail must include an effective unsubscribe method and a postal address. Do not use purchased, rented, scraped, or otherwise unauthorized lists. You must honor an unsubscribe and a suppression request.
4. Plans and billing
Plans are described on the SendNeo pricing page. They charge for emails sent and provide unlimited contacts. Paid plans are prepaid monthly or yearly. Yearly billing provides two months free. You may cancel at any time; service continues through the end of the paid period. There are no partial refunds, except when Yorker Media closes an account without a breach of these terms.

Every paid plan includes every feature. Above 1 million emails per month, contact Yorker Media. If a plan's monthly email allowance runs out, transactional mail and welcome or confirmation emails can continue for up to 20% more while you upgrade. Broadcasts wait until the allowance is available. We may change plan prices or limits with notice for future billing periods.
5. Acceptable use
You must follow the Acceptable Use Policy. Yorker Media may investigate abuse, protect recipients, or comply with law. Automatic suppressions, broadcast pauses, and account review thresholds are described in the product documentation.
6. Suspension and termination
We may suspend or limit an account when we reasonably believe it violates these terms, harms deliverability, threatens security, creates legal risk, or fails to pay. We may also act on a complaint, bounce pattern, phishing report, or abuse report. Where practical, we will give notice and an opportunity to correct the issue. We may terminate an account for a material or repeated breach, non-payment, or a legal requirement.
You may stop using SendNeo and cancel your plan. On termination, you may request an export of available account and contact data, subject to legal retention, suppression obligations, security limits, and the retention periods in the Privacy Policy.
7. Data and privacy
You retain rights in content and contact data you submit. You grant Yorker Media the limited rights needed to provide, secure, maintain, and improve the service. Yorker Media processes customer-uploaded contacts as a processor where applicable. See the Privacy Policy for details.
8. Service changes
We may update, suspend, or discontinue features. We will take reasonable steps to communicate material changes. Documentation may describe operational limits that are part of the service, including rate limits and review controls.
9. Disclaimers
SendNeo is provided on an as-available basis. We do not guarantee delivery to every recipient, uninterrupted operation, a particular inbox placement, or that every message will be permitted by a receiving provider. You are responsible for backups of your application data and for reviewing messages before sending.
10. Liability
To the fullest extent permitted by law, Yorker Media is not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for lost profits, revenue, data, or goodwill. Our aggregate liability arising from the service is limited to the amount you paid to Yorker Media for the service during the twelve months before the event giving rise to the claim. This limitation does not exclude liability that cannot lawfully be excluded.
11. Changes to these terms
We may revise these terms by posting an updated version and changing the update date. Material changes will be communicated through the service or the account email where practical. Continued use after the effective date means you accept the revised terms.
12. Governing law and contact
These terms are governed by the laws of India. Courts in India will have jurisdiction, subject to any mandatory consumer or other law that applies. For legal questions, contact legal@yorkermedia.com.
